DIVORCE CHECKLIST


This form is for use by persons who are contemplating a divorce.

These questions are offered as a public service to help you make notes to aid your attorney of choice. Take this information to your attorney when you meet with him/her the first time. Keep this information absolutely confidential


1. What is your full legal name?

Your date of birth?
Your Social Security Number?
Your mailing address?
Your home and work telephone numbers?
Your e-mail address?


3. With regard to your employment:

What is the name and address of your employer?
What is your AVERAGE GROSS [total income BEFORE deductions] per week?
What were your gross earnings for 1996 and 1995?
Have you, in the last year, changed jobs? If so, where did you work before?
Have you worked overtime during the last year and, if so, how much of your income is overtime?


4. What is your spouse's full legal name?

Their date of birth?
Their Social Security Number?
Their mailing address?
Their home and work telephone numbers?


5. With regard to your spouse's employment:

What is the name and address of their employer?
What is their AVERAGE GROSS [total income BEFORE deductions] per week?
What were their gross earnings for 1996 and 1995?
Have they, in the last year, changed jobs? If so, where did they work before?
Have they worked overtime during the last year and, if so, how much of their income is overtime?


6. Do you or your spouse own any real estate, be it in your names or together with someone else? If so, for each parcel:

Briefly describe it [i.e., is it a house, farmland, empty lot, etc?]
Give its address.
Give its approximate fair market value at this time.
State how much, if anything, you still owe on the property.
Give the approximate date that the property was purchased or, if it was a gift, the date that it was given to you.


7. Do you or your spouse have any bank accounts, including checking, savings, certificates of deposit, etc.? If so, for each, give:

The name of the bank and the type of account [e.g., checking, savings, etc.].
The amount in the account as of today's date.
The name or names that appear on the account.


8. Do you or your spouse have any debts, such as credit cards, car loans, medical billsetc? If so, for each, list:

The name of the creditor [the credit card company, bank, doctor, hospital, etc.].
The amount of the debt.
The amount of the minimum monthly payment.


9. Do you or your spouse own any motor vehicles? If so, give:

The year, make, and model of each vehicle.
The approximate value of each vehicle.
The amount owed on each such vehicle.
The amount you pay for insurance on each vehicle.
State who drives the vehicle most of the time and for what purpose [i.e., is it used to drive to and from work, is it used as part of work, is it used to go to the grocery store, etc.]


10. Do you have any other assets that are worth more than $100.00?

For example, list the total value of furniture, the value of any coin or baseball card collections, jewelry, tools, recreational vehicles [boats, four-wheelers], etc..
For each such grouping, give an approximate value.


11. Did you bring any assets INTO the marriage? If so, list them.


12. Did you receive any gifts or any inheritances during the marriage? If so, list them.


13. What are your average monthly living expenses?

Your rent/mortgage?
Your utilities, such as gas, water, sewer, electric, garbage, phone, cable?
Your monthly car payment?
Your house insurance and real estate taxes?
Your groceries?
Any other monthly expenses?


14. Do you and your spouse have any children together? If so, give:

The name and date of birth of each child.
Do any of your children have any special health needs?
If any child has completed high school, are they attending or planning to attend college?


15. Do you or your spouse have any children as a result of OTHER relationships? If so, give:

The name and date of birth of each child.
Do any of those children have any special health needs? If any child has completed high school, are they attending or planning to attend college?


16. Did you help your spouse complete a college or professional education?


17. Do you have any health problems that may affect your ability to earn a living?

If so, briefly describe each and every such problem.


18. Did either you or your spouse do anything during the marriage that resulted in the spending of marital assets unreasonably, such as gambling or giving money away to others without the permission of the other spouse? If so, please describe any such incidents.


19. Have you attempted any counselling? If not, why not?


19. Do you believe there will be a dispute as to who gets custody of any children?

If so, list five to 10 of the strongest reasons you believe that you should have custody.
